U. S. REFUSE TERMS AND CONDITIONS:
Customer acknowledges that it has care, custody and control of equipment owned by U. S. Refuse and accepts responsibility for the equipment except when it is being physically handled by U. S. Refuse. Therefore, customer expressly agrees to defend indemnity and hold harmless U. S. Refuse. from and against any and all claims for loss of or damage to property, or injury to or death of person or person resulting from or arising in any manner out of customer’s use, operation or possession of the equipment furnished under this contract. Customer agrees not to overload, move, or alter the equipment and shall use the equipment only for its proper and intended purpose.
Customer acknowledges that U. S. Refuse. shall not be liable for any damage to pavement, asphalt or driveway resulting from its trucks servicing an agreed upon area. Also, U. S. Refuse will not be responsible for fines obtained due to lack of service days and customer cannot off set invoices to cover the balances of fines.
This Agreement shall continue for 12 months from the effective date set forth above and may be terminated by either part upon 30 days prior with notice by phone, email, or standard postal mail specifying a termination date, at the end of contract term or with a 30 days prior written notice at any time with the breach of the service agreement. This contract shall automatically be renewed for successive one-year terms (each a renewal term) thereafter unless either party shall give written notice of termination by certified mail to the other at least thirty days prior to the termination. This Agreement is a legally binding contract on the part of U. S. Refuse. and customer and their respective heirs, successors and assigns. In accordance with the terms and conditions set out herein.
The amounts due hereunder may not be offset against any claims, changes, accounts, or other obligations due from U. S. Refuse. to customer. Amount billed for the period divided by the number of collections for which billed minus 50% for landfill disposal costs equals the credit/refund amount.
TERMS: Balance due 30 days after Statement Date. A full 2% late fee per month (or fraction thereof) shall be due for accounts not paid within this period. Full payment MUST BE POSTMARKED WITHIN 20 DAYS OF THE STATEMENT DATE. In case of non-payment and your account is place on “stop service”’, a $25.00 reconnection fee will be charged to your account in order to restart the service at your location.
Customer grants to the undersigned (U. S. Refuse.) the exclusive right to collect and dispose of all customers waste materials and agrees to make the payments as provided for herein and U.S. Refuse agrees to furnish such services and equipment specified above all in accordance with the terms of this agreement.
Because disposal and fuel costs constitute a significant portion of the cost of service provided hereunder, customer agrees that U. S. Refuse. may increase the rates hereunder proportionately to adjust for any increase in such costs or any increases in transportation cost due to changes in location of the disposal facility. Customer agrees that U. S. Refuse. may also increase the rates from time to time adjust for increases in the consumer price index, increases in the average weight per container yard of the customers waste materials and increases in cost due to changes in local, state or federal rules, ordinances or regulations applicable to U. S. Refuse. operations or the services provided hereunder and increases in taxes, fees or other governmental charges assessed against or passed through to U. S. Refuse.
Customer agrees to provide unrestricted access to the equipment on the scheduled collection day. If the equipment is in accessible so that the regularly scheduled pick up cannot be made U. S. Refuse. will promptly notify the customer and afford the customer a reasonable opportunity to provide the required access; however, U. S. Refuse. reserves the right to charge an additional fee for any additional collection service required by customers failure to provide such access.
Customer will be considered in breach of this agreement if it (1) fails to pay service fees as set forth in this agreement; (2) attempts to terminate this agreement without prior written notice as set forth in this agreement; and/or (3) fails to comply with any of its obligations set forth in this agreement. Customer shall provide GCI with written notice any problem which it believes constitutes a failure by GCI to fully perform its obligations under this agreement. GCI will be considered in breach of the agreement if GCI does not cure the problem in 10 business days after receiving such notice where GCI determines, within reasonable judgment, that the problem does not constitute failure by GCI to perform its obligations, or where such problem is beyond GCI’s reasonable control, GCI shall not be obligated to cure such problem and this agreement shall remain in full force and effect. GCI shall not be liable under any circumstances for any special, incidental, or consequential damages arising out of or in connection with the performance or non-performance of this agreement.
In the event customer terminates this agreement prior to its expiration (other than as a result of a breach by U. S. Refuse. or lack of payment on the part of the customer), customer agrees to pay U. S. Refuse. liquidated damages as calculated as follows: (Two Months of the full contracted price set forth in this service agreement) not including military and government workers who is being relocate out of the area. Customer expressly acknowledges that in the event of an unauthorized termination of this agreement, the anticipated loss to U. S. Refuse. in such event is estimated to be the amount set forth in the foregoing liquidated damages provision and such estimated value is reasonable and is not imposed as a penalty. In the event customer fails to pay U. S. Refuse. all amounts which become due under this Agreement, or fails to perform its obligations hereunder, and U. S. Refuse. refers such matter to an attorney; customer agrees to pay, in addition to the amount due, any and all costs incurred by U. S. Refuse. as a result of such action to the full extent permitted by law, reasonable attorney fees. U. S. Refuse reserves the right at the end of the agreement between the customer and U. S. Refuse to charge the customer $150.00 per totter if the equipment is not available and/or not reusable (Fair Condition).
Trash collection will occur between the hours of 5:00am and 7:00pm on schedule collection days of service. All carts for collection should be placed curbside no later than 5:00am on the day of collection. Carts must be placed with in 6 inches off the curb and with the handle facing toward the property. Do not block the sidewalk. Please allow for three feet of space between collection items and other obstacles such as mailboxes, phone poles, and vehicles. U. S. Refuse will only dump trash that is inside U. S. Refuse equipment. U. S. Refuse is not authorized to handle other trash haulers containers (even if altered, name and logo of company removed, etc). Customer agrees not to overload, move, or alter the equipment and shall only use the equipment for its proper intended use. U. S. Refuse reserves the right to bill the customer for any cart in need of repair due to customer negligence or misuse. Repair request should be made to U. S. Refuse customer service department at (301) 486-7502 U. S. Refuse will not pickup bags weighing more than Fifty pounds or any items that cannot be safely loaded or any items that may damage Goode Companies equipment or employees. Example of this include but are not limited to items such as flammable products or liquids, Gasoline, oil pan, cans, tires, animal carcasses, tree stumps, dirt, stone, rock, brick, lead, acid, wet cell batteries, railroad tires, toxic or bio-hazardous materials or waste, propane, oxygen, helium tanks, items containing gas such as Freon, explosives, live ammunition or weapons, or construction debris. U. S. Refuse is not responsible for personal trash containers and lids that are lost or damaged.
U.S. Refuse will provide solid waste service on the corresponding scheduled days, except for the following holidays Christmas, New Year’s, Independence Day, Memorial Day, Thanksgiving and Labor Day. If your solid waste or recycling collections fall on one of the above holiday’s solid waste collection will be removed one day after your normally schedule service day. Barring any weather and /or uncontrollable circumstances solid waste or recycling will be collected on the next service day.
